US President Donald Trump said on July 8, 2026, that he will ask the US Supreme Court to rehear a case challenging his executive order aimed at curtailing birthright citizenship. This move seeks to overturn the court's rejection last month of one of his key policies.
The Supreme Court had ruled that Trump's directive violated the 14th Amendment of the US Constitution, which grants citizenship to anyone born in the United States who is “subject to the jurisdiction thereof.” The decision, authored by conservative Chief Justice John Roberts, was described by Trump as a “miscarriage of justice.”
Trump stated on social media, “AMERICAN CITIZENSHIP IS NOT FOR SALE! In fact, that is a crime, and therefore, the Supreme Court’s ruling is wrong.” He added that he would be requesting a rehearing by the Supreme Court immediately.
The US Supreme Court rarely grants requests to rehear cases and has not done so in decades after issuing a ruling in an argued case.
