A federal judge has agreed to dismiss the convictions of four members of the Proud Boys for their involvement in the January 6 Capitol riot. District Judge Timothy Kelly signed off on the Justice Department's motion to vacate the convictions of Ethan Nordean, Joseph Biggs, Zachary Rehl, and Dominic Pezzola.
Judge Kelly noted in his memorandum that President Trump's views on the prosecution of those involved in the Capitol attack—"whether those views are based on fact or fiction"—and his intention to extend clemency through an Executive Order played a role in the case's dismissal. Kelly expressed that there was "little mystery about why the Government is moving to dismiss this case, or whether dismissal is in fact what the Executive seeks," and cited a lack of other levers to prevent the move.
In 2023, Nordean, Biggs, and Rehl were convicted of seditious conspiracy and sentenced to lengthy prison terms. Pezzola became widely recognized after video footage showed him smashing a Capitol window with a riot shield. The Justice Department stated that Nordean and Pezzola "participated in every consequential breach at the Capitol," leading Proud Boys in dismantling barricades, breaching the Capitol building, assaulting police, and causing property destruction.
Judge Kelly remarked that "it is hard to see how any course other than granting the motion in full could make practical sense," though he also noted uncertainty about how the court would respond to more detailed information regarding the government's reasons for seeking dismissal.
The decision comes amid ongoing political and legal debates surrounding the January 6 events and the subsequent prosecutions.
