On Friday, August 1, 2026, Jeanine Pirro, United States Attorney for the District of Washington, D.C., dropped charges against David Hearn, a former Olympic athlete who faced up to 10 years in prison for allegedly defacing the monument.

Hearn was accused of pulling up pieces of the new sealant installed during President Donald Trump’s renovation of the pool earlier this year. Hearn contended he was merely investigating pre-existing damage.

According to a motion filed on the same day, additional documents indicated that the damage to the reflecting pool was caused by flawed installation work by the contractor, not by Hearn's actions. This development led to the dismissal of charges.
