A federal judge on Wednesday, August 26th, 2026, declined to order Texas to extradite Immigration and Customs Enforcement (ICE) officer Christian Castro to Minnesota, where he faces charges of assaulting a migrant. The decision aligns with Texas Governor Greg Abbott, who has requested additional time to decide whether to comply with the extradition request.

The case centers on allegations that on May 14th, Officer Castro fired a gunshot into a home, wounding an occupant, according to Judge Fernando Rodriguez Jr., a Trump appointee to the southern Texas court. Minnesota authorities fear Castro might flee to Mexico if extradited.

Governor Abbott, a Republican ally of former President Trump, has framed the dispute as a conflict between red and blue states. He has stated he will not act on the extradition until Minnesota Governor Tim Walz acknowledges and addresses what Abbott describes as extensive pandemic and Medicaid assistance fraud occurring in Minnesota, a Democrat-led state.

“While they’re making demands, I got a demand of my own, and that is: It’s time for Minnesota to step up and repay the United States of America and Americans for all the fraud that they have committed in their state under federal programs,” Abbott said earlier this month.

Judge Rodriguez emphasized that the law permits the governor to take his time and declined to impose an artificial deadline for the extradition decision. Officer Castro remains in custody in Cameron County, Texas, following his arrest on May 29th.
