Emily Moreno, the ex-wife of Rep. Max Miller (R-Ohio), filed a federal lawsuit on Wednesday, August 13th, 2026, alleging that Miller published a nude photo of their young daughter online. The lawsuit claims Miller “recklessly published and disclosed to the world a nude image” of the child.

According to the suit obtained by The Hill, Miller gave the photo as part of a Dropbox folder to his lawyer Aaron Minc amid a collection of documents and photos intended to defend his political career against Moreno’s domestic abuse allegations. Miller then posted a link to the Dropbox folder on the social media platform X following a live stream where he defended himself.

Moreno’s legal team stated that the defendants have refused to disclose how many times the intimate image was accessed, viewed, or downloaded, nor have they identified who might have done so. Moreno claims more than 400,000 people accessed the Dropbox folder and that she never consented to Miller or Minc publishing the images.

The lawsuit emphasizes the recklessness of Miller’s actions, noting the risks in today’s environment with threats such as pedophiles and AI-generated image manipulation. Moreno wrote, “Miller’s recklessness is underscored by the fact that any parent knows — in this era and world filled with pedophiles, creeps, and AI-generated image alteration and video generation — not to put nude pictures of their child, or any child, on the public internet.”

A senator, commenting on the situation, described the release of the photos as “grotesque” and stated, “My personal opinion is that this is a felony, and that every single human being that touched that photo and transmitted it electronically should go to jail because it is illegal to do that.”

The lawsuit seeks a judicial finding that Miller and Minc violated Ohio state and federal laws, requests $150,000 in damages for the daughter, and asks for judgment in the daughter’s favor on all claims.

Earlier in August 2026, the House Ethics Committee launched an investigation into Miller after he filed paperwork requesting the panel to investigate him.
