Hundreds of thousands of Haitians living in the United States face imminent risk of arrest and deportation after the Department of Homeland Security (DHS) resumed ending Temporary Protected Status (TPS) for Haiti. This development follows a June Supreme Court ruling that limited judicial review of the TPS program, enabling immigration enforcement to detain Haitians on a large scale.

US district judge Ana Reyes confirmed on Wednesday, August 7, 2026, that her previous order blocking DHS from terminating TPS for Haiti was no longer in effect. DHS Secretary Markwayne Mullin stated, “We’re going after them right now,” signaling the agency's renewed efforts despite ongoing violence and political unrest in Haiti.

The TPS protections, initially granted during the Trump administration, had allowed Haitians to live and work legally in the US for years. Their removal exposes many to deportation back to a country facing significant instability.
